Hello and thanks for helping! I have had a hardship situation since May due to my small son carrying an infectious disease. I have had unexpected medical expenses and other related (diet, care, etc). I have never been late or missed mortgage payments. After being shut down for any options, like trying to get money out of my retirement account or try to refinance, I applied for a temporary loan modification with Wachovia. I called today after 3 months and they told me to update the financial documents. Now, in these 3 months, something else happened. My husband business partner decide to retire and asked him for ,000 to sell his part or he would go and sell it to someone else. We tried to get any commercial loans thru banks but they were denied (and we still have excellent credit). We ended up taking the money form our home equity line. My question is: What is the best way, if any, to document that new situation when updating my hardship letter and financial statements for Wachovia? Thanks a lot.

I refinanced my House in May 07 with world savings.
the primary loan is 334k, I have about 165k equity in it
Whne I refied my mortgage broker also advised to pay off all remaining debt on my credit record
I had been saddled with a late relatives CC debt when they died and being the authorized used the credit carc company (HSBC) passed on the debt to me (The relative’s lawyer shouldve payed it)
I disputed it with HSBC but they refused to remove it.
So World Savings broker told me they would be paying off this old debt and a few other late collections of around 700 dollars.
Well in November of this year I had an accident, emergency home repairs and perfect storm of bad stuff happen.
I went to world savings for home equity line of credit. They told me Wachovia has bought them, but with my 165k in home equity i would get the line of credit’EASILY’
they dragged their heels and finally a month later sent me a letter denying me loan because my credit rating is low.
I have pulled my credit
i pulled my credit reports and am in shock
World Savings said they would pay of old collections
There is NO RECORD on any of my credit reports that these collections were EVER payed off.
So my credit is still bad because of World Savings failure and now theyre turning me down for home equity line of credit for their own failings!
OMG im about to have a stroke!
what should I do ?
i keep excellent records. im staring at my HUD statement right now.
im just shocked by this catch 22
man Im going to go ballistic on the phone tomorrow morning
my broker was paid 6900 in his fees alone
on my hud is is listing 5405 that was to be paid to the owed creditors (4 total)
only 1 of the 4 shows on my credit report as being payed off

Our mortgage is about at 0K and our home is worth 0K. Is there a percentage the banks use to calculate for a home equity loan or….do you get the full K?

I don’t have enough equity, all of a sudden, in my home. I have Good Credit, Steady Income. but because of no equity, I am unable to refinance. Wachovia stopped Modifying Loans just today (7/2/08) and I don’t want to forclose. Do I have to wait and become behind in monthly mortgage payments before I can request a short sale from the Lender? Please let me know.

When I refinanced my mortgage in May 07 the mortgage broker included 5405.01 in payments allocated to credit collections on my HUD statement.
His broker fees were around 6900.
I explained that the bulk of the CC collections was for a deceased relative’s account of whom I was only the authorized user.
My broker said it would tak eso long to dispute it that i was better of refing and paying it off and that my credit score would go up a lot.
Well 7 months later in late November I needed a small home equity loan. I have 165k in equity in my house still and World Savings/Wachovia assured me I should easily get the loan.
Instead they turne dme down due to credit rating.
I pulled all credit reports.
3 of the 4 owed creditors still show up. So my credit was not improved!
Who was responsible for the payoffs ? My mortgage broker or the title company ?
i should add that ive just gone thru junk mail and found a collection agency dated 11/07 still demanding payment on the largest collection. (4600- HSBC wasonly authorized user though) ironically theyre only asking for 50% of total.
if they were payed why are they stll asking?
what a headache. 
To last answerer, Im in PA.
HSBC switched the debt to my name after my late grandfather died.
this was several years ago and at the time i was flush with cash and working a 60 hr a week job in nyc. So the only thing i did was call hsbc and write them a letter telling them since i never opened it, to remove me.
i also wrote the credit reporting agencies.
I shouldve followed up. But HSBC are total @##$%^ to have transferred it to me.
Now I will follow up on it one way or another.

I currently have a 5:1 ARM interest only 0 down mortgage on my condo. The market has dropped and I am upside down on my property. I can afford my payments but want to move back up to NH to be with my family and my fiance. I am allowed to refinance next November due to a soft prepayment penalty and my mortgage doesnt reset until 2011. My problem is that even if I rented I wouldnt be able to meet the 1272 mortgage/taxes 325 HOA and 10 % cost of property management for a realtor to manage property. I also wont be able to refinance if I have negative equity and i dont have money to bring to the table. I am just not sure what my options are. Any advice is much appreciated as I have begun to investigate a short sale and I don’t think my lender Aurora Loan Services will write down anything on my mortgage to redo the terms. I know I am stuck like many other Americans and I have learned a hard lesson but I am looking for any help or advice. Thank you very much!

I have an excellent credit rating and my property is worth more than I need, but I’ve been turned down twice for things that are beyond my control. Wachovia didn’t like that I live on a 30 acre farm, and Citibank didn’t like that my home is not stick built. Any suggestions on where else to try?
Thanks for the suggestion, but that won't help me.
