Who is responsible for a home equity loan after someone dies?

My mother died, and her house is in her living trust. Her husband signed a quitclaim deed saying he had no interest in the house a few years earlier. However, her husband took out a home equity loan against the house earlier this year (so this is AFTER he gave up his right to the house). So, *his* name is on the loan, but not my mother’s. Will the loan be tied to the house, or to him? That is, is he responsible for paying it back, or will the heirs to the house be responsible? Thanks in advance.
This is in California, in case that makes a difference. Thanks!
To add more detail, the house will belong to me according to the trust, but we haven’t settled that yet. Will the bank make me carry the loan before the house is transferred to my name, or is the husband personally responsible?

Need a loan & own our home?

We own our home, but have only been in it for about 2 weeks. So, my question is this: we have bad credit like 500, but need a loan for improvements & to pay off our car. Where do you suggest going? What institutions? the house is in great shape & worth a lot of money. Also, can i do a refinance cash out since we don’t have a mortgage will that work? Or am I just looking @ a home equity loan? House given to us free & clear, how do we go about getting a home equity loan?

My grandparents are giving us their 2nd residence home. No money owed on it, title will be ours next week. Here’s my question: we want to pay off some debt & do home improvements, but I am concerned about the seasoning clause. What banks/lenders offer home equity loans without a seasoning clause? Since there is no purchase amount, will they go by the appraised value in this case? Thanks in advance.

What option would be best to get money from my mortgage?

My wife and I were going to try and refinance our mortgage as our interest rate is 6.25% and the rate had dropped more than a percent. This was the bank’s idea, they actually called us and wanted to set up a meeting. When we got there we went over some ways we could save money, but they wouldn’t allow the the refinancing because my wife’s credit score was too low.
My friend suggested a home equity loan which is, from what I understand, is a loan based off how much non-interest money you’ve paid on the loan. As you can tell I’m not 100% on this.
We took out a loan for about 0,000 and the last value of the house was at about 5,000. The catch here is that I’ve only owned my house for about 3 years so I’ve only actually paid like ,000 on the principle. I’ve never missed a payment, or asked for an extension; and I usually pay more than the amount they ask for.
My plan, if possible, would be to get about 00-00 to pay off some bills, mostly medical. It seems when you go to the hospital these days you get a bill from the hospital, the doctor, the assistant, and pretty much anyone you talk to. The bills aren’t that much in total, but each one wants you to pay a certain amount which is annoying. I’m hoping paying these and clearing any credit card debt will raise us enough to get approval for refinancing.
I do plan on talking with the bank, but I like to come here first just to get a better idea of things.

Note: I am on a fixed rate, I will never go to variable. Also we plan on living here the rest of our lives. We both have very good, very steady work in healthcare.
The idea is once these misc. bills that I pay 0 or so a month to are gone, that money could be slapped back on the monthly mortgage over-payment. I usually paid several hundred over but as the number of the number of these little bills increased, it took away from that and I’m pretty much not paying any extra.
401K is out, as this is my first job that offered it and I have next to nothing. We are a young couple, both mid-20s.

Home buying for dummies?

My boyfriend and I have started talking about buying a home, the only problem is that we literally have NO idea what to do, where to begin, what to have done, ANYthing. We are complete babies when it comes to this. We’ve been renting apartments for a couple years and now that we have a son (11 months old – starting to get into EVERYthing) we would really enjoy the stability of owning a home and also being able to have a place with a yard for our son to play in. We keep hearing that this is the best time to buy but we truly don’t know where to begin. Home loan this, equity line that, percentage rates, mortgage..? Where do we begin?! We haven’t found a home yet but our lease will be up at our apartment soon and we’re hoping to find one before then. Can anyone give me some tips or a website where I can go read up on what all I need to do? We are both 23 years old, he is about to be promoted in restaurant industry, I’m a stay-at-home mom with not so great credit, he has no credit. Are we even eligible for home owning? SOMEONE help me! Can you do a Deed-in-lieu of foreclosure if you have a home equity line of credit on your home?

I am considering the Deed in lieu of foreclosure option but I have a Home equity line of credit on my house. Is this something that can still be done? BTW I live in Florida if that has any bearing on the answer.

Our broker is wanting to give us a Heloc 2.85% rate for our first house. Will we be paying off any principa?

We were told a Heloc 2.85% Heloc would be the best for us to keep our mortgage down. We were told that the prime rate is most likely going to go down and if it did go up it would be very minimal, and our mortgage payments would stay the same till our 5 year term was up and then we could renegotiate.

Also with a Heloc are we paying anything at all in principal???

The price of the house is 340,000. Our rate would be 2.85%.

Calculation question, what is better to pay off overall with consideration to tax deductions…?

I am trying to decide what is best to start using my extra money to pay off…a student loan at 5.4%, an auto loan at 4.99% or a heloc at 7.75% I know student loans and heloc interest is tax deductible, but assuming these deductions don’t affect a change in bracket (tax rate) what is the calculated difference in interest saved (assuming 15% bracket) on whether to pay which of these three….(I guess I’ve always been told pay non-deductible first, but with these numbers I just don’t see how that adds up…and most importantly how do I actually calculate the real interest I’m paying on tax deductible interest so I can compare it to nondeductible rates…) thanks in advance for any help!
