home equity loan responsiblity?

On a home equity loan during a marriage. If a check was created, Would that check require both spouse to sign that check> As the documents require both signatures to acquire that loan. if the moneys are in the form of a line of credit, does the checks to dispense funds require both signatures?

Mortgage company won't give wife any information?

My husband and I took out a mortgage through GMAC in 2005. We are both listed in the document as "borrowers" and both of our signatures are on it. We both initialed each page of the mortgage document as well. There is a second, much shorter document titled "Open-end Mortage" which appears to establish a home equity line of credit. Only my husband’s signature is on this document. The documents bear the sig. of the Notary Public, but there are no other witness signatures.

Whenever I contact the mortgage lender to find out any information about the mortgage, I am told they cannot give me any information – they can only give it to my husband. How is this possible if both of our names are on the mortgage? This is in the state of Ohio.
Just to clarify: the second document, which carries only his signature (which was done without my knowledge) was for an HELOC Piggyback loan account (although it is called an ‘open-ended mortgage’).The main document – the Mortgage itself – carries both his and my signatures.

I currently live in a house in California that has my grandfather, my father, and me on the deed. We are each 1/3 owners of the property. It is completely paid off — there is no mortgage. I was wondering if there would be any way I would be able to get a HELOC on the house WITHOUT the signatures or permission from my father or grandfather. They are both skeptical people and swear that banks are out to screw people over. They also do not know anything about real estate and they swear real estate is nothing but risky investments. I cannot get them to just deed the house over to me because they have no education on real estate and they swear they have to be involved for some reason. My father and grandfather don’t make any of my decisions and haven’t since I’ve been an adult for the last 10 years. This would help greatly if someone could offer some advice! This house has so much equity and it’s time I start expanding my real estate portfolio! Thank you so much.

signed over there share of the property to him ( my mother in law expressed that the house should go to him- he had been helping pay off the mortgage) The rest of his siblings want to be paid for their share of the property. Can we get a loan on the property in order to pay the rest of the siblings with only the two signatures? From what I understand in Tx if you die without a will all property goes to all your heirs equally. The house is paid off but is in need of repairs. We would like to sell the property but his siblings do not want to pitch in for the repairs and are not in a position to pay off the taxes that are owed on the house. We already own our home and don't want to get a home equity loan on ours to fix up his mom's house. Please help.
