Can I change name on home deed if currently listed as estate and home equity line of credit open – see details?

Home was gifted to me via Will.
An open home equity line of credit for ,000 is open on this home and payments are made monthly through estate.

Money in Estate will run dry long before H.E.L.O.C. is paid, but I can replenish estate with my own monies (approx 0 month) and am not very concerned with the loan.

I just want to know if I can put the home in my name prior to loan being paid off? Am guessing I would have to put the loan in my name first?

Thanks for any help, this is all new to me. I know I could go to an estate lawyer but am trying to handle all affairs I can without ringing up a large bill.

Is a "quit claim deed" all I need?
Must I change the loan to my name? Loan has very favorable terms (interest rate).

first time home buyer loans or grants?

i was thinking about buying a house at the beginning of the year, its this one here:

and i was thinking about getting a first time home buyer loan but i don’t quite know how they work. by the conditions listed i know me and my gf qualify but how does that work with actually buying the house? would that push the monthly mortgage up or is it a grant? would i have to get the loan for the house at the same bank i get the first time buyer loan? and being that i’m getting the first time loan that supposed to cover down payment and closing costs, would i have to pay anything out of my own pocket or will the bank tell me that?

Can you figure out the logic behind this debt/equity question?

I was asked this question on a completed exam. I have the answer now, but I don’t really follow the logic behind it. Please give me your answer, and a description of WHY YOU CHOSE THAT ANSWER. I’m still not sold that the teacher shouldn’t throw this out. Thanks.

Foreclosure…bank seeking judgment on Home Equity Line of Credit?

I was told by my real estate agent that if I did a short sale or foreclosure on my home in Arizona, that both the first mortgage and Home Equity Line of Credit (taken out 9 months after home purchase) would both be relinquished in a short sale or foreclosure. Because the house had dropped significantly in value and half the lots were vacant from owners doing the same thing, I decided to proceed with the short sale. It wasn’t approved and went into foreclosure. Now the bank is pursuing judgment against me to garnish my wages. Unfortunately, I can’t afford to retain an attorney. Is this a case I can win, even if I represent myself in a civil suit against this realtor? I also have email documentation asking him specifically how both loans would be treated. He responded with "Don’t worry, I have it!" I also have a witness to him telling me this verbally. According to the anti-deficiency laws, the second loan is not forgiven because it’s Non-Purchase Money, is this correct? Also, I’m wondering if I have a strong enough case to pursue this in civil court, representing myself.

I’ve now been turned down by 3 different institutions. I cannot understand why someone won’t make this NO-BRAINER loan!
My condo is fully paid for and worth million. It’s in The W Hotel complex here in Dallas, and one place that turned me down said the issue was that it’s a "condotel" – or a condo located within a hotel…I don’t understand this – but maybe it’ll mean something to those reading.
I am self-employed.
Does anyone know who I could try?
I have tried Bank of America (my bank), Frost Bank and a local firm, Texas Lending.

Would refinancing our home to a lower rate enable us to get cash out?

We just purchased our first home back in March of 2009 at a 30yr fixed 5% interest rate. It is an FHA insured loan and we are eligible for a "streamline" if the interest rates drop below our 5%. If the rates do drop below 5% over the next couple of months, would we be able to get cash with the new refinance? We would go with another 30yr fixed below 5%. We bought our home for 0k in March 2009 and our payments are ,400+ a month with everything included in that payment.

The reason I ask is because we really need to get ,000 asap. What about equity line of credit? Is it possible that our home is worth a little bit more than what we paid back in March 2009? We did a lot of cosmetic modifications to it. But I know equity loans are much higher than our current 5% interest rate.

I am new to all of this. Thanks.

If I had a friend that would give me a loan, can I use my house as collateral?

I own my house (am mortgaging it), have 40k equity in it, but do not have the credit to get a home equity loan. If I knew someone (a friend) that would lend me a little bit of my equity, can i use my house as collateral to them? and how would I go about doing it if so?
what are the steps, and how would it go? if i dont have the title myself, the mortgage co. does, so how would it work, to give someone part of the equity?
is there anyway to do it without the 2nd mortgage? like maybe a contract saying that "if i dont pay him/her back they can take my house or something?" lol?

Implications of a Fund Raiser for Personal Gain?

My family and I have a new house on 5 beautiful acres out in the country. We just found out that the 12 acre cornfield next to us may be sold and subdivided for 4 or so houses. I don’t want anyone to build there, and would like to buy the property. The problem is that I don’t have enough money to cover the payment, and I already have a home equity loan (we were going to finish our basement….it’s not enough to buy the land).

I got to thinking, "if I could get a bunch of nice people to just donate 2 or 3 bucks to me, no strings attached, maybe I could raise enough money." I know it sounds questionable; it wouldn’t be a pyramid scheme, since I would make it clear that these are donations (to me). Furthermore, if people donated to me, but I ended up not having enough to buy the land, I’d turn over the money to a real charity.

Would this be legal? What would the tax implications be? How could I convince people I have good intentions?
My parents can’t afford to buy the land either. I plan on begging my father-in-law soon. Other than that, lottery tickets might be our only alternative….?
