I purchase a house that had one mortgage they sold the mortgages and now i have 2 mortgages that i have to pay.
one is 180,000 and the other is 30,000 i can only pay for one. can i pay for the most expensive one and file bankruptcy on the 2nd one and continuing living in the house

First wave of sub-prime mortgage defaults over.
Second wave of mortgage defaults coming now to higher quality credit risks. These are people who have bought homes in the last five years and who have taken out home equity loans. Mortgages now going under water owe more than house is worth. This wave of defaults will take upwards of 10 to 12 months to clear.
Third wave of mortgage defaults due to begin this year and continue through 2011 are Option Arms and Altay; as payments are automatically resetting to higher rates. We saw some fail last month because of a 3% rate hike, next month is the beginning of the end as rates start to climb even higher.
Estimated – 8 million defaults in next four years.
As if this is not enough we have the next huge failure to come in the commercial real estate market, that will make the sub-prime fiasco look like kids play!
Then comes credit cards and auto loans in the end.

2 mortgages on the primary home that will remain in good standing (no late payments). The 2nd mortgage is with the same lender as the investment house. If the investment house forecloses with negative equity, will the first home be in jeopardy?

I’m being forced to relocate for my job, and I’m trying to avoid foreclosure or a short sale- I’d like to try to keep current on as much of my debt as possible. My home is currently worth less than half of what I owe (in florida). I do not qualify for refinancing because ratio of the value of the house to loan value. The notes are held by Freddie Mac. I am hoping that they will write a portion off, with the understanding that I’m still paying on a value far higher than I could sell for. (Mortgages worth K, HELOC of K, current home resale value ~0K. I just want to be able to rent it and keep my head above water. Help.

I sold my home in NH in a short sale. To buy the home originally we did an 80% and a 15% loan. So we started with a standard loan and a home equity loan. I heard recently that new laws state that in a short sale if the home equity loan was used to purchase the house then it is not recoverable by the bank after a short sale. Is this true? Right now the bank is coming after us for that amount.
