How can I legally kick out my adult nephew who is damaging my house?

My sister and I inherited my parent’s home, which was paid for, 8 yrs ago, joint co-owners with survivorship. My sister lives in the house with her husband and 29 yr old son. My husband and I live in the same town in another home. My sister and I are very close. She didn’t want to sell the house and wanted to live in the home with her family indefinitely with the understanding I was welcome to stay with them if I ever wanted to move in. We agreed to split the money if we ever decided to sell. However, her son’s behavioral problems have gotten worse over the years and he has been uncontrollable for the past 5 years. He has been in and out of jail, is disrespectful, and has been damaging the house, tearing up, and breaking things. He has a terrible drug problem, refuses to work and expects my sister (and me) to keep him up. My sister is a sweet, wonderful, hard-working person who means well but she enables my nephew and has a hard time telling him "no." Although she has a great job, she is broke b/c she gives her money to my nephew. She spent her retirement funds to keep him out of jail. A few years ago, she took a home equity loan on our house (I to consolidate her debts. My nephew constantly harasses her for money and threatens her if she doesn’t do what he says or threatens to punch the wall or tear up something in the house. We have tried to talk to him and he has gone to rehab but hasn’t changed. When he first started punching holes in his bedrm walls, I called a family meeting to discuss his behavior and told him he had to stop destroying the house. He hasn’t been sober in a year so he is difficult to talk to b/c his thoughts are clouded by the chemicals. I have tried talking to my sister about kicking him out but she says he is her son and she can’t follow thru with it. My brother-in-law has tried to discipline him but my nephew sarcastically tells him it’s not his house and he can’t do anything. He starts arguments between my sister and her husband so that he can control the house. I cannot stand by any longer and let him devalue our house. I want him out of there but I’m not sure what to do. It causes me a lot of pain to see the home my parents worked hard for be destroyed. He brings his party friends and girls in and out of the house at all hours of the day and night. It is sad. What can I do to stop this? Thank you for any advice. Worried In NC

I stopped paying my mortgage & may declare bankruptcy. Will the 2nd mortgage be forgiven ?

I am a teacher with a secure job & possibly getting divorced. I can’t afford my upside-down mortgages alone. Is bankruptcy a good option to try to keep my home? Will the 2nd mortgage be forgiven so I can stay here? What other options do I have?

It didn’t sell for a whole year after being on the market? When we first moved in our Double Wide home 3 years ago, which is a 93′ model, it had old fridge, stove, washer, and dryer (maybe from the early 90’s). We replaced all of those appliances in a matching set. They are all white fridgidaire. We bought those brand new. Also since we moved here, he replaced the whole AC unit and Hot water heater. He also painted a few of the rooms which were wallpapered from when it was built.. so you can imagine the walls looked nasty. The only thing i think will turn people away is the carpet, which is a blue and has wrinkled up i guess you could say. We are talking about having someone come in and clean it and tighten it up. Also, the kitchen floor has a few mud stains on it and some other little problems here and there (nothing major). We are trying to get out of debt and that is why we are trying to sell the home. He bought the house 3 years ago for ,000. When we got it appraised a year ago (before we updated everything and made all the changes), they appraised it as 121,000. I was shocked. Now that we have done all of these repairs, i am thinking that if we sell, we can use the remaining balance to pay off our debts, get married and move into a nicer home with cheaper payments or at least look for something in better condition. We have 2 loan bills over 1,000$ a piece from having to replacing the AC and a couple of other reasons. We also have 2 credit cards and our furniture bill that we racked up from buying the new appliances for the kitchen. Since our credit is bad, we cannot get approved for a home equity loan, a personal loan AND we cannot refinance. My boyfriend has a 12 hour job that he works 6 days a week and he would get a 2nd job to get out of debt, but they keep changing up his hours and they are not understanding about anything. Everything is very overwhelming and hard to deal with and selling the home seems to be our only option of saving from foreclosure and causing our credit score to drop even more. Please let me know what you think we could do.. and also.. if we put the house up for the market, are we allowed to have our stuff in here while they come look at it? I always see pictures online of homes for sale and they are always empty. :/

If a home equity loan is charged off, can they still foreclose?

Does the collection agency have the right to foreclose, or is it considered an unsecured debt? We are facing foreclosure with first mortgage. We are about k underwater with the first mortgage. If the house is foreclosed, there will be nothing left of the house for the second mortgage. House value has plummeted nearly 0k. Husband lost only employment after 10 years. One son is disabled and recently found out another has brain damage (may require surgery). I have been in charge of getting them to all their medical appointments (4x a week). We have considered declaring bankruptcy. We have no assets except for a 401k, and a 12 year old car. I live in FL. Can the collection agency garnish wages when my husband finds another job? Would bankruptcy discharge this debt?

Do Home Loan Modifications include our equity loan?

Mortgage is with Chase, equity loan is also with Chase. We applied for a loan modification. Due to job loss, decreased pay we cannot continue to make our home loan and equity loan payments.

Wondering if they will adjust/combine our equity loan in our home loan modification. I can’t get a straight answer from Chase regarding specifics until underwriter has approved.

Does any one know, or has had experience with Chase or this scenario.

Is there any home loans for first time buyers with less than one year of steady work?

My boyfriend and I have found our dream home. But we have a few problems. He has only been at his current job for about 7 months. He makes about 00 a month before deductions. I just started working a few weeks ago and I am going to be making about ,000 a month before deductions. We both don’t have very good credit. And we do not have a down payment. We were told we could get a loan with zero down. But all the loans I have seen require you to have good credit and at least 2 years of steady employment. Maybe I am looking in the wrong places. Can someone give me some advice or point me in the right direction? Thank you.

I will not have enough for a down payment. Yes, I know it is better to have one, but I do not, and desperately need to purchase my home. I am responsible and pay my bills on time, my credit is good my middle score is 692, my debt to income ratio is 36%. I want to get a loan to try to take advantage of the 1st time home buyers credit.

Perhaps you didn’t hear my question… please read the first sentence and do not answer unless you can advise me of some lenders that do offer zero down home loans… that is why I posted the question.

In addition my debt to income ration IS NOT HIGH and you are ridiculous for saying so, my loan officer today told me that my debt to income was perfect and where it should be… upon further investigation this website will explain it to you so that you can understand:

Home value is well below 1st mortgage and we have no plans to move. 1st mortgage is current but due to job loss could not keep up 2nd. What happens if I don’t file Chapter 13?

First time homebuyer with zero down?

Here’s my situation: Looking to buy a home. I have little (K max) to Zero down (preferably zero). I have NO DEBT. ZERO. I owe nothing to anyone. My credit cards have a zero balance, my car is paid for. ZERO DEBT. I personally make K a year. I will have someone living with me who makes K a year. I have been employed steadily for 15 years (I’m 33) and have rented the same apt for the duration of that time never having been late even once on the rent. I’m employable in multiple fields so if my current job goes south I wouldn’t have trouble finding another job. I had a couple collections issues in my early 20’s for medical bills (One of which I disputed) but have since had two loans (both paid off early) and a few credit cards (all open and with no balances and again, never been late or had collections issues). I’ve got a 401k and life insurance with equity I can borrow from. Anyone have any idea how likely it is for me to get a home loan with zero down? Or a home loan at all? I’d be looking for possibly up to 0K. If you think I could get approved anyone know what a good lender might be? Lending Tree? BoA? US Bank? Any advice appreciated.
