I finally get all fact straight and I visited lawyers. Bank of America signed a Home Equity Loan of Credit to husband a year ago. House is in NH, loan was signed in Ca, because we separated 8 + years and divorcing. Three months after Bank release the fund, Bank found out there are two people(husband and I) on the title. So Bank sent me the paper work to sign. no Signature of me, of course. Lawyer said I can save half of the equity by foreclosure but I don’t want to move. Husband has got into 100k credit cards debt tried to keep up all bills. So my house value, at current market, is 350k to 390k, first mortgage 100k, HELOC is 250k,He doesn’t want to have bad credit on his record. So he works hard to paying it. Lawyer asked 10k retainer fee and no one tells me how much it will cost till the whole thing straight out. Is it worth it for me to fight? I’m homemaker for 20 years. This matter bothers me so much and my health is going down and I’m so worried everything will collapse. my older kid goes to college,40k/year,She may not able continue because we can no long afford it. Advice on what the best I can do to save my kids and me out of this situation?

Debt & Divorce?
Thursday, September 17th, 2009I’ve been married for just over a year and have had a very rocky marriage that will likely end in divorce over the next 6 months. I had a baby and gave up my business to be a stay at home mom. I had a salon with clients, which I gave up to get married (and would take years to start over) When I left, I still had 30k left in credit card debt (from college, I couldn’t get the student loans to pay for everything and had no job), and just 4k left in student loans. We didn’t accrue any debt together when we were married. I know I’ll get child support, but I’ll still have to work to cover the rest of rent and car payment, etc. The interest rates are horrible and anytime I ask to have them lowered they never do (because I pay the minimum on time). I can’t afford to pay much more than the minimums now, so it will never get payed off. What is the best way to pay down my debt? Should I get a house on my own and refi in a year or 2 and use the equity to pay it all off? CCC?
Well he already has 3 kids from his last marriage and has done really good paying child support and pays extra for lessons or whatever, so I don’t think that will be a problem.
He went through a bad divorce with his ex wife and he doesn’t want to tear eachother apart by going through counseling. He doesn’t expect things to work out so he doesn’t want to go to counseling because he thinks it will only add to problems, and stress – which is bad for his health.
At this point I think I’ll be happier on my own, its just an issue of how to support myself and my baby without having to send her to daycare. Right now I can work from home and not have to pay other bills, because until we split he still pays stuff. So its a prime time for me to pay stuff off – does anyone have any suggestions for stuff to do from home? I used to be an excellent sales and office admin and learn very quickly. If I can have 2/3rds paid off when we split up, the remainder won’t be so bad.
Beneficial Finance – Is refinancing available on a existing mortgage which is through a "Private Lender"?
Thursday, September 10th, 2009The individual & his partner that sold us the property carried the full purchase price amount (less the down payment), as a "Contract of Sale". Over the last couple of years both parties (buyers & sellers) have been faced with some kind of financial, real estate, health &/or family "issue(s)", one of which, is being us, the buyers. Thus causing our Mortgage payments to fall behind, drasticly. So in order to refinance, (with Benificial or another Mortgage / Lending Company), they would be paying off two individuals (the partners), not a actual "Mortgage Company". Does this create a problem? What if the property is in foreclosure, how would that effect the odds of getting refinanced with a new Mortgage Company?
Although, there’s at least one good thing in our favior…
Currently we have approx. 55k equity in the property.

Wednesday, August 26th, 2009My ex has the house. The only collaterol I have is some IRA’s that have double the value as my debt.
What alternatives are out there? What do you suggest?
I have great credit, pay on time, not behind. I am wanting to get a home within a year, but will not be able with such a large debt. This monkey on my back is stifiling.
