my property has too much Equity, my attorney filed a Bankruptcy Chapter 7, & later on after filing for ch 7 our attorney realized that our equity is high so then he asked me & my husband 2 convert 2 Bankruptcy CH 13, this alarmed us, We are so comfused & scared more than ever, We are current with our primary Mortgage & 1st & 2nd Loan with our Bank that is tied up with our property, our balance is $ 129,000.00 & our Appraisal is for 5,000.00 & we are current with our Property Taxes/Homeowners Insurance. & we are current with our car payment & auto insurance. Our reason 2 File for Bankruptcy in the 1st place was because of personal credit card debts, we were told from our attorney that we do qualify for CH 7, Now our attorney tells us we do not qualify for ch 7 so we have to convert to CH 13, but he says our home is not secured with the 0,000.00 Home Exemption. our children are all Adults, even though they live with us, & we support them financially the court does not reconize my college children as our dependents under the law and because 2 of them file for thier own tax-return for years now so I only have one adult dependent age 18 who is still a full-time student in High School. another thing the lawyer said 2 us when after we signed the forms for ch 13, last week friday. that we qualify for a 100% Pay Back Plan. not reduced like they do for Consolidation, & not even once did the lawyer mention anything about consolidation so I am really comfused, I even asked an attorney at the Pro-Bono work shop @the Santa Ana Bankruptcy Court House 2 weeks ago & I asked if its safe to convert my case to a ch 13 to keep my property & personal property safe they said yes, & that I would have to pay what I could only afford a month from my husbands income for a 5 year plan"so I thought ok, this is good" But, when I saw my lawyer last week 2 sign 4 the convertion to a CH 13, she said my minimum payment would be around ,000.00 a month 2 pay back my creditors & that’s the lowest payment the court would offer according to our attorney 2 start with & it will go higher in a couple of months "We can’t afford this" what should we do? this attorney is confusing us, my English is fluent but, the legal terminology is very confusing" if you have been through something like this before (or) if you know someone that had gone thru this in CA we would really appreciate any feedback you may offer, I tried 2 call my attorney again & she does not return calls I am scared for me & my family. Thanks 4 listening hope 2 hear from someone that would have knowledge to give us feedback that is true no matter how bad it ism we want to know what to expect & what we should do.

Does anyone know what to expect in Bankruptcy Ch 13 in the state of California ? I'm scared need advise"?
Monday, April 12th, 2010My husband got my family in major financial straits.?
Thursday, January 21st, 2010He will deny everything he has done and blame me, his wife for everything. On occasion he will take some blame. He did not have an income (he always makes sure to spout off that he is in fact working) for a couple of years and no benefits for his family.
No matter what -he has stayed his own course even though financial ruin has been around him. No income, selling his watch to a pawn shop, bringing his wedding ring in to get a loan-then get the ring back, increasing anger, 60K of credit card debts, personal loans from friends–always doing it behind my back, oh and the worst part during all this he would dip into our home equity and say he needs to then all the while he does work per se though has no or spotty income. After a 2 year adjustable arm mortgage he put us in (i would cry and say no I do not want to refinance again) we almost went under. I got our house out of foreclosure by the grace of God.
He tends to still be this Napolean Man and surely this is not the guy I married. I am not sure if he is ill, or addicted to power and control?, or hiding substance abuse? Or chemical imbalance in his brain?
I just want him to get well. I have children to raise with him and after him calling me bad names, etc. ie. abuse on all levels….well just feeling frustrated like when will this end! Has anyone seen someone just throw in the towel for their marriage/family? I mean at times we barely have any money to buy a gallon of milk. I am always frantic running around like a chicken with my head cut off picking up the pieces (ie. getting jobs, etc.) I am scared that he is hiding something that he did. I mean when you see financial ruin for so long is it just depression or something more? Anyone go thru something like this?
Therapists tell me to just focus in on me and my children and let his chips fall where they may. But see what they do not know is he is still loved by me (i love the man he used to be) and he is an amazing Father. Even though he has been cruel to me I still love this Napolean Man!
He has a lot of addiction, ie. alcoholism and drug addiction and depression in his family.
He thinks money is going to solve this (yea some of it it will) but I think there are deeper issues.
Thanks
What happens when a person goes bankrupt? I have a lot of friends who have so much credit card debt & I am?
Saturday, September 26th, 2009I am wondering if they would be better going bankrupt but I have no idea what the consequences are for this…I always just work harder & do more things & so I don’t know what they are going through but don’t want to tell them to do things the way I do them….they actually might not be able to work enough & I am afraid one of my friends is going to get sick from pushing so much. So I would like to know what is best….she has a lot of credit card dept & the companies have made it very hard for to pay back by raising her rates when she has done nothing…..anyway, she has a mortgage & equity loan & everything was good until she ended up with a large amount of hospital bills…So if she goes bankrupt & focuses on just paying back her home & equity loan what would be the consequences & would she still owe on the large credit card debts? ..what if she sells her house in a few years & has done well by then will she have to go back & pay off the credit cards or are they just wiped clean?
What does it mean when the FED slashes the interest rate.?

Home equity vs. Home equity line of credit?
Saturday, September 5th, 2009I need to do some repairs on my home and I’m not sure what the advantages are to either a home equity line of credit or a home equity loan. Any advice?
Can anyone help here? Seeking a personal loan?
Thursday, July 16th, 2009I am seeking a personal loan in the amount of ,000.00. I am willing to repay this at 12% interest over 60 months with the payment being 0.00 monthly.
It is needed to pay off my second mortgage and some credit card debts.
I can easily afford this payment if the other items are repaid. I currently do not have enough available equity in my home or I would go through a bank, paying off my second mortgage will give me about ,000 of equity in my home, thus being able to refinance my first mortgage, thus paying off this loan sooner, which is what I am aiming for here.
What happens with Home equity loans and lines of credit if you file bankruptcy?
Wednesday, July 8th, 2009Would these debts be "forgiven" also and if so, does this affect your house which was used to achieve the loan?
A credit card company put a lien on my home even after bankruptcy wiped out the debt.?
Monday, June 8th, 2009I filed chapter 7 bankruptcy to get out from under several credit card debts including citibank. They are listed in my bankruptcy and they are also listed on my credit report has being satisfied by a bankruptcy. But when I refinanced my home, the title search came up with a huge(twice the original amount) lien on my home by citibank. My attorney said this was an oversight and it had no merit so he wrote a letter to the title insurance company and they were happy. But now, 2 years later, the same situation is up again while I'm trying to get a home equity loan. This needs to stop! What can I do?
