Default on Home Equity Line?

About a year ago my family experienced a horrible financial hardship when I lost my job. We also lost our home in foreclosure during this time as well. When we were in good standing thoguh we had a 10K dollar home equity line that we had used to "fix up" the home. This was a secured debt tied to our home as is customary. When the house went into foreclosure, the bank that issued the home equity line was only paid 1500.00 by the first mortgage holder instead of the full 10K. Why this happened I have no idea, since the contract verbage states that if I default they take possession of my home and can go as far as auctioning it off if need be to collect.

Recently I have been receiving calls from the bank that issued the home equity line want to set up payment arrangements with me to pay this debt off. We do not have the money to amke these payemtns since my current position literally pays 40% less than I was amking prior to my job loss. The bank has also threatend to file a judgement against me and possibly garnish my wages. My question is this: If the debt was secured with my home, and the bank did not collect when the house was sold/ went into foreclosure thne what rights do they have to file a judgement or even try to collect? IN other words can they actually sue me or are they simply trying to get me to sign off on an "unsecured" loan so that they can actually hold that document over my head??? ( this option is on the table at present) Please help…. we are in a desperate finacial time already and surely can’t afford to pay any more than we already are. It is a struggle just to "eat" and pay the utility bills not to mention a 250.00 loan payment.

Questions about home equity options?

My wife and I have a home that have been appraised at 0,000. and we have an outstanding mortgage of 2,000 (3 yr. closed term 5.5%). We would like to move next summer into another house due to a new development in our neighbourhood. We have an outstanding debt of ,000 which consists of a line of credit at 7.9%, and a credit card at 9.9%.

My question is, should I refinance with another bank at their offered rate of 4.25% (open variable), and move the line of credit over to theirs (4.75%), and use the equity in the house to pay off the debt; or should I wait until next summer and use the proceeds from the house sale to pay off the debt?

How can I verify the validity of a check written on Charter One equity line?

HELP! My crazy husband sold a car over the weekend and accepted an 00 check from a family. The lady assured him the check was good and said it was her "home equity" line. The check just says Charter One, but no address or contact number for the bank. I will be taking it for deposit to my credit union today, but is there a way for me to verify that it is good prior to waiting to see if it bounces??? We live in Georgia and find no brances in this state. Any advice?

Foreclosure…bank seeking judgment on Home Equity Line of Credit?

I was told by my real estate agent that if I did a short sale or foreclosure on my home in Arizona, that both the first mortgage and Home Equity Line of Credit (taken out 9 months after home purchase) would both be relinquished in a short sale or foreclosure. Because the house had dropped significantly in value and half the lots were vacant from owners doing the same thing, I decided to proceed with the short sale. It wasn’t approved and went into foreclosure. Now the bank is pursuing judgment against me to garnish my wages. Unfortunately, I can’t afford to retain an attorney. Is this a case I can win, even if I represent myself in a civil suit against this realtor? I also have email documentation asking him specifically how both loans would be treated. He responded with "Don’t worry, I have it!" I also have a witness to him telling me this verbally. According to the anti-deficiency laws, the second loan is not forgiven because it’s Non-Purchase Money, is this correct? Also, I’m wondering if I have a strong enough case to pursue this in civil court, representing myself.

can the bank sue me if my home foreclosed for the money?

In 2007, I was tricked into a Heloc Home Equity loan for 480K based on my great credit on a house I’ve never seen in Georgia. I live in florida. I later found out that I was not on the primary loan, yet was the sole person on the Heloc. The total amount owed is 1.4 mil, but now worth not even 350K. Do you think a short sale would be a solution? Or just let it foreclose? and if it foreclose, can the bank sue me?

Home Equity line of Credit…what should I do?

We recently were approved for a home equity line of credit to purchase another home. Now, I have heard that some banks are lowering or eliminating these lines of credit due to property values going down. Would it be wise for us to go ahead and pull that money and put it away or just wait a little while longer say 1 to 2 months when I know that we will definitely need it? Thanks ahead of time for your answer!

Question about appraisal for Heloc Home Equity Line of Credit…?

I’m going through BOA (Bank of America) for a home equity line of credit. I thought my house was worth about 5k based on comps and market analysis. They did a "desktop" appraisal and it came back at k. I just purchased the house for k and was hoping to get a HELOC to do some work and upgrades to the house. THey said they "upgraded" the appraisal and were doing a drive-by (I did not mention I thought it was low). Is there anything I can do in hopes of recieving a higher appraisal? Any tips??

Mortgage /Home Equity Question?

I currently own my home, and I’ve never had a mortgage, I paid in cash for it. Now, I am thinking of using this residence as a rental and buying a new home, as I need to relocate across the country and I prefer not to sell in a down market. I would say my credit is fair…not excellent with a few medical bill blemishes. When I apply for a loan at the bank, can I use my home equity to secure it? Or will I need to apply for an unsecured mortgage? Any help on this would be greatly appreciated.
I already own this home free and clear. I have never mortgaged it. This will be the first time I’m getting a mortgage. I can afford it…..I’m not really considering defaulting to be an issue. I just need to know what type of loan I need.

Is it possible for me to put my mom on my home equity line of credit so she can use money?

when she needs it. My husband and I are the only ones on the deed. She is not a part owner of the house. So wondering if this is possible and if it is possible…..where do I go to a bank…and get this taken care of???
